Terms of Service

These Terms of Service ("Terms") govern your use of BangMarket — the website at bangmarket.io and the associated paid members' feed delivered through Whop (collectively, the "Service"), operated by the individual responsible for BangMarket (the "Operator"). By using the Service you agree to these Terms.

1. What BangMarket is

BangMarket is a performance broadcast: the Operator publishes the trade fills (entries, pyramid additions, exits) generated by the Operator's own automated trading bots on the Operator's own brokerage accounts. Subscribers receive that broadcast via a private members' feed hosted on Whop (web and mobile app) for informational and educational purposes.

2. What BangMarket is not

The same broadcast is sent to every subscriber. The Operator does not know your circumstances, account size, broker, leverage, or risk tolerance and does not tailor anything to you.

3. Trading risk

Trading XAU/USD on leverage carries a substantial risk of loss, including loss greater than your initial deposit. Past performance — backtest, simulated, or live — does not guarantee future results. You may lose all of the capital you commit to trading. Only risk capital you can afford to lose. See the Risk Disclosure.

4. Eligibility & geographic restrictions

You must be at least 18 (or the age of majority in your jurisdiction) and legally permitted to trade leveraged FX/CFD products where you reside. Paid subscriptions are not offered to residents of the United States as the Operator is not registered with the SEC or CFTC. The Operator may decline to provide or continue providing the Service in any jurisdiction.

5. Subscriptions, billing & refunds

Billing and access management are operated by Whop. By subscribing you also agree to Whop's terms and Stripe's terms. Subscriptions auto-renew at the term you selected (monthly or annual) until cancelled. You may cancel any time from your Whop dashboard; access continues to the end of the current billing period, after which your access to the members' feed is automatically revoked.

Refunds: all sales are final once signals have been delivered for the period. Goodwill refunds may be issued at the Operator's sole discretion in clear cases of technical failure (e.g. an extended outage where no signals were delivered due to our error). Statutory refund rights in your jurisdiction (e.g. UK / EU 14-day cancellation rights for digital services) are not waived by these Terms.

6. Acceptable use

You may not (a) re-distribute, re-publish, copy, or resell the broadcast to non-subscribers; (b) use the Service to operate a competing service; (c) share your Whop account or member credentials; (d) reverse-engineer, scrape, or automate access to the Service. Violation may result in immediate termination of access without refund.

7. Service availability

The Service is provided on an "as is" and "as available" basis. The Operator may pause, modify, or discontinue the Service (in whole or in part) at any time. Whop and broker downtime are outside the Operator's control. Broadcasts may be delayed, missed, or incorrect due to model failure, infrastructure issues, or market events.

8. Intellectual property

All content on the Service — broadcast messages, charts, written material, code, and brand — is the property of the Operator and protected by applicable copyright and trademark law. Subscribers receive a personal, non-transferable, non-sublicensable licence to consume the broadcast for their own informational use only.

9. Limitation of liability

To the fullest extent permitted by law, the Operator and its service providers shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages — including without limitation lost profits, lost trading capital, lost data, or business interruption — arising from your use of, or inability to use, the Service. Total aggregate liability for any claim is capped at the amount you have paid for the Service in the twelve (12) months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law (e.g. for fraud or death/personal injury caused by negligence under UK law).

10. Indemnity

You agree to indemnify and hold harmless the Operator from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.

11. Changes to these Terms

The Operator may update these Terms from time to time. Material changes will be communicated via the Service. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the Operator's jurisdiction of residence, without regard to its conflict-of-laws rules. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of that jurisdiction.
